Abstract

Against the background of the, due to COVID-19, cessation of attendance teaching at institutions of higher education in Austria, numerous students returned to their home countries at the beginning of the summer term 2020, not occupying their accommodation in student dorms. Frequently the Austrian Students Ombudsman at the federal ministry for education, science and research (BMBWF) was conducted with requests in that period of time, whether it is possible to prematurely terminate the contract of utilization with the student dorm. The following article aims at constituting the legal issues related to this question.
