Abstract

French Abstract: Le présent texte, qui sera publié dans un ouvrage collectif dirigé par Jean-Bernard Auby, vise à décrire la réponse du système judiciaire canadien à la COVID-19, tout en essayant d’en tirer une réflexion éthique. Dans un premier temps, nous introduisons les grands principes procéduraux du contentieux canadien (section 1). Deuxièmement, nous décrivons les réactions de ce système à la pandémie (section 2). Troisièmement, nous élaborons une cadre analytique, composé des concepts de célérité, de flexibilité et d’équité, afin de discerner les bases de la réflexion éthique du contentieux canadien eu égard aux défis pandémiques (section 3). Enfin, quatrièmement, nous considérons l’héritage de la COVID-19 pour le système judiciaire canadien, suggérant que le recours aux audiences virtuelles deviendra incontournable tout en insistant qu’il y aura lieu de formaliser un cadre analytique qui permettrait au système judiciaire de répondre aux défis causés par d’autres vagues de la COVID-19 ou d’autres pandémies (section 4).

English Abstract: The purpose of this text, to be published in a collection edited by Jean-Bernard Auby, is to describe the response of the Canadian justice system to COVID-19, while attempting to engage in ethically-minded reflection. First, I introduce the main procedural principles of Canada’s litigation system (section 1). Second, I describe the system's responses to the pandemic (Section 2). Third, I develop an analytical framework, consisting of the concepts of timeliness, flexibility and fairness, to discern the basis for ethical thinking in Canadian litigation in light of pandemic challenges (Section 3). Finally, fourth, I consider the legacy of COVID-19 for the Canadian justice system, suggesting that the use of virtual hearings will become unavoidable while emphasizing that there will be a need to formalize an analytical framework that would allow the justice system to respond to challenges caused by future waves of COVID-19 or other pandemics (Section 4).
