본 연구에서는 분쟁당사자들에게 분쟁해결에 만족을 주어 ADR이 정착되기 위해서는 조정인의 역할이 중요하다고 보았다. 코로나 19 팬더믹 상황과 같이 비대면으로 분쟁을 해결하기 위하여는 온라인 조정이 활성화되어야 하며, 이를 위하여는 분쟁당사자들에게 만족을 줄 수 있는 해결방안을 이끌어 내는 조정인의 역할이 매우 중요하다는 점을 강조하였다.
조정인의 역할은 의사소통 촉진시키고, 당사자들의 이해를 증진시키며, 당사자들이 그들의 이해관계에 초점을 맞춰 스스로 합의에 도달할 수 있도록 창조적인 문제해결을 추구하는 등 포괄적이다. 분쟁을 해결하는데 있어 조정인은 첫째, 조정인은 우리나라의 조정절차의 성공적인 정착여부가 자신들에게 달려있다는 자부심과 사명감을 갖고 조정절차에 임하여 하며, 둘째, 조정인은 분쟁에서 당사자들의 자 잘못을 평가하여 결론을 도출하는 평가인 조정인이라기 보다는 촉진형이면서 문제해결 조정인이라는 인식의 변화가 필요하다.
창조적 문제 해결자로서 조정인은 단순히 분쟁을 해결하려고 하는 시도이외에 당사자들 간의 관계를 지속시키기 위해 상호 의사소통을 촉진시켜 상호 이익이 될 수 있는 해결책을 도출하도록 하여야 한다. 이러한 역할을 잘 수행하기 위해서는 조정에 대한 전문교육을 이수함과 동시에 조정인 포럼 등을 통한 조정기법에 대한 노하우를 습득하는 것이 매우 중요하다고 하였다.

In anticipation of an upsurge of disputes arising from or relating to COVID-19, small disputes and non-monetary disputes are expected to increase, and demand for online mediation is also expected to expand. The costs of mediation are lower than the disputed amounts, making it an economical way to resolve disputes. Mediation can save time too. Even considering that online mediation reduces costs and brings an efficiency and convenience to the resolution through replacing previous physical face-to-face meeting with non-face-to-face online communication, it is still required to secure impartiality, credibility, and legitimacy. The competence of mediators is very important in order to settle disputes over Online mediation.
This study focused on the role of mediators while considering the need for the Corona 19 pandemic and mediation system from the perspective that the role of mediators is important for ADR to be settled by satisfying dispute resolution to the parties to the dispute.
The role of the mediator is comprehensive, promoting communication, promoting the interests of the parties, and pursuing creative problem solving so that the parties can reach agreement on their own by focusing on their interests.
In resolving disputes, mediators must have creative problem-solving ability as a relationship-oriented and communication facilitator of the parties. A creative problem solver must present a solution that can benefit the parties to the dispute, in addition to simply attempting to resolve the dispute. He said that it is very important to cultivate mediators who can earn the trust of the parties as a factor for activating online mediation in the corona 19 pandemic situation.
